Firm Recovers for Injured Truck Driver

Curnutt & Hafer, LLC recently concluded settlement for a truck driver injured in a wreck that occurred when another driver apparently fell asleep at the wheel, and struck the client’s front wheel from the opposite direction on a rural highway. The client successfully recovered through a very diligent regimen of physical therapy, thereby avoiding low back surgery. The firm coordinated with the client’s physician and an economist to obtain net settlement recoveries of $310,000 for the client through diligent prosecution of the claims.

Settlement Obtained for Client in Breach of Contract Case

Douglas R. Hafer and Logan W. Simmons represented a small business owner who had sold his company. Significant disputes arose over what was acquired and the parties’ obligations. The small business owner sought over a million dollars in damages relating to the buyer’s breach of an indemnity provision contained in the parties’ asset purchase agreement. After years of a very contentious litigation, Mr. Hafer and Mr. Simmons obtained a favorable monetary settlement for their client.

Arbitration Win in Business Dispute

Firm partner Kelly Curnutt represented a businessman in a recent arbitration hearing in Fort Worth, Texas. The case arose from the purchase of a business by the firm’s client, which he was induced to do by false statements of the sellers. The sellers initiated the arbitration proceeding on claims against the firm’s client for failing to assume the business’ real property lease, and the firm asserted counterclaims against the sellers for breach of contract and misrepresentation. The arbitrator denied all the sellers’ claims, and instead ruled in favor of the firm’s client, awarding damages and attorneys’ fees.

Favorable Settlement Reached During Jury Trial in Oil & Gas Case

Along with local counsel, Kelly Curnutt represented a Fortune 500 oil & gas operator in a suit brought by several different mineral and landowners claiming $3.5 million in damages from the drilling of a well. The case was tried to a jury in Texas State District Court for several days before a settlement and agreed judgment was obtained that included dismissal of all the plaintiffs’ claims, and the entry of a permanent injunction precluding the plaintiffs from any further interference with the operations of our firm’s client.
